1. Acceptance of Terms
By downloading, installing, or using the Worka mobile application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these terms, you do not have permission to access the App.
2. Service Description
Worka provides a digital fitness training platform that offers:
- Personalized training programs and exercise routines
- Demonstration videos and instructions
- Progress tracking and statistics
- Training plans and calendars
- GPS workout tracking (running, cycling)
- Heart rate monitoring via Bluetooth devices and Apple Watch
- Route maps and performance analysis
- Heart rate zone tracking
- Calorie, pace, distance, and speed calculations
- Health metrics integration via Apple Health (iOS) and Health Connect (Android)
- Daily health tracking including HRV, VO2 Max, sleep analysis, and resting heart rate
- AI-powered coaching and personalized workout recommendations
- Apple Watch integration for real-time health data synchronization
3. User Accounts
3.1 Account Creation
- You must provide accurate, complete, and current information
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- You may create an account via email or third-party services (Google, Apple)
3.2 Age Requirements
- You must be at least 13 years old to use this App
- Users under 18 years old must have parental consent
3.3 Third-Party Authentication
- If you register using third-party services (Google, Apple), you accept their terms
- These services are provided by Clerk (authentication service)
4. Device Permissions and Access
To provide our services, the App requires certain device permissions:
4.1 GPS Location Permissions
- The App requests location access for running and cycling workouts
- GPS tracking only occurs during active GPS-enabled workouts
- Data is used to calculate distance, pace, speed, and display maps
- Tracking stops automatically when the workout ends
4.2 Bluetooth Permissions
- The App requests Bluetooth access for heart rate monitors
- We only connect to devices you explicitly pair
- Data is used to calculate training zones and intensity
- You can disconnect Bluetooth devices at any time
4.3 Notification Permissions
- The App may request permission to send push notifications
- Used for workout reminders and updates
- You can disable notifications in your device settings
4.4 Health Data Permissions (Apple Health / Health Connect)
- On iOS, the App requests access to Apple Health to read health metrics (HRV, VO2 Max, sleep, resting heart rate, walking heart rate average)
- On Android, the App requests access to Health Connect for equivalent health data
- Health data is only read with your explicit permission granted through the operating system
- You can revoke health data permissions at any time through your device settings
- The App syncs health data to our servers to provide personalized insights and coaching
- Health data from Apple Watch is also synchronized when available
5. Third-Party Services
The App uses the following third-party services:
5.1 Map Services
- Apple Maps (iOS) and Google Maps (Android) for displaying routes
- These services have their own terms and policies
5.2 RevenueCat (Subscription Management)
- We use RevenueCat to manage subscriptions and payments
- Payments are processed through App Store (iOS) and Google Play (Android)
- We do not store credit card information
5.3 Clerk (Authentication)
- We use Clerk to securely manage user authentication
- Clerk provides sign-in with Google, Apple, and email
5.4 Cloud Storage Services
- Your data is stored on secure cloud servers (AWS, Google Cloud)
- We use industry-standard providers
5.5 Apple Health and Health Connect
- On iOS, we integrate with Apple Health (HealthKit) to read daily health metrics
- On Android, we integrate with Health Connect for equivalent functionality
- Data read includes HRV, VO2 Max, sleep analysis, resting heart rate, and walking heart rate
- We only read data — we do not write to your health platforms
- These integrations are subject to Apple's and Google's respective terms and policies
5.6 AI Services
- We use third-party AI services (Anthropic) to power our AI coaching features
- Your fitness data (workout history, health metrics, goals) may be sent to AI services to generate personalized recommendations
- AI-generated content is for informational purposes only and does not constitute medical or professional fitness advice
- AI conversations and recommendations are processed in real-time and not stored by the AI provider beyond the session
You acknowledge that these third-party services have their own terms and privacy policies.
6. Health and Safety Disclaimer
6.1 Medical Disclaimer
IMPORTANT: The fitness content provided in this App is for informational and educational purposes only and does not replace professional medical advice, diagnosis, or treatment.
- You should consult with a healthcare professional before beginning any exercise program
- You are participating in the exercises at your own risk
- You are voluntarily participating in these activities with knowledge of the risks involved
6.2 Physical Activity Risks
You understand that physical exercise can be strenuous and may cause injury. Worka will not be liable for any injury or damage resulting from use of the App.
6.3 Health Data Limitations
- Heart rate and zone data are approximations
- Accuracy depends on the connected Bluetooth device or Apple Watch
- Health metrics from Apple Health and Health Connect (HRV, VO2 Max, sleep) are provided by your device and may not be fully accurate
- GPS data may vary based on signal conditions
- Calculated calories are estimates
- AI coaching recommendations are generated by artificial intelligence and may not be appropriate for your specific health condition
- This data is NOT for medical diagnosis or treatment
7. Subscriptions and Payments
7.1 Subscription Plans
- Prices are subject to change with notice
- Subscriptions auto-renew unless canceled
- Payments are processed through App Store (iOS) or Google Play (Android)
- No refunds are provided for partial periods
7.2 Cancellation
- You can cancel your subscription at any time through your device settings
- Cancellation will be effective at the end of the current billing period
8. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Share your account with others
- Copy, distribute, or modify any App content
- Attempt to extract the source code
- Use the App in a way that could damage, disable, or impair the service
9. Intellectual Property
9.1 App Content
All content, including videos, text, graphics, logos, and software, is owned by Worka or its licensors and is protected by intellectual property laws.
9.2 User Content
By sharing content on the App, you grant Worka a worldwide, non-exclusive, royalty-free license to use such content.
10. Privacy
Your use of the App is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
11. Limitation of Liability
Worka will not be liable for:
- Indirect, incidental, or consequential damages
- Data loss or service interruptions
- Personal injuries resulting from App use
- Inaccuracy of GPS, heart rate, health metrics, or calculation data
- Third-party Bluetooth device or Apple Watch failures
- Inaccuracy or unsuitability of AI-generated coaching recommendations
- Errors in data read from Apple Health or Health Connect
- Any loss exceeding the amount paid for your subscription
12. Indemnification
You agree to indemnify and hold harmless Worka, its directors, employees, and affiliates from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
13. Modifications
13.1 To Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App.
13.2 To Service
We may modify or discontinue any aspect of the service without notice.
14. Termination
We may terminate or suspend your account immediately, without notice, for:
- Violation of these Terms
- Conduct we believe is harmful to other users or Worka
- At our sole discretion
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
16. Dispute Resolution
Any dispute related to these Terms will be resolved through binding arbitration, except that you may file claims in small claims court if they qualify.
17. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
18. Entire Agreement
These Terms constitute the entire agreement between you and Worka regarding the use of the App.
